मैं साध्वी प्रज्ञा चंद्रपाल सिंह ठाकुर, उम्र-38 साल,
पेशा-कुछ नहीं, 7 गंगा सागर ...अपार्टमेन्ट, कटोदरा,
सूरत,गुजरात राज्य की निवासी हूं जबकि मैं मूलतः मध्य
प्रदेश की निवासिनी हूं. कुछ साल पहले हमारे
अभिभावक सूरत आकर बस गये. पिछले कुछ सालों से मैं
अनुभव कर रही हूं कि भौतिक जगत से मेरा कटाव
होता जा रहा है. आध्यात्मिक जगत लगातार मुझे
अपनी ओर आकर्षित कर रहा था. इसके कारण मैंने
भौतिक जगत को अलविदा करने का निश्चय कर
लिया और 30-01-2007 को संन्यासिन हो गयी.
जब से सन्यासिन हुई हूं मैं अपने जबलपुर वाले आश्रम से
निवास कर रही हूं.

आश्रम में मेरा अधिकांश समय
ध्यान-साधना, योग, प्राणायम और आध्यात्मिक
अध्ययन में ही बीतता था.

आश्रम में
टीवी इत्यादि देखने की मेरी कोई आदत नहीं है,
यहां तक कि आश्रम में अखबार की कोई समुचित
व्यवस्था भी नहीं है. आश्रम में रहने के दिनों को छोड़ दें
तो बाकी समय मैं उत्तर भारत के ज्यादातर हिस्सों में
धार्मिक प्रवचन और अन्य धार्मिक कार्यों को संपन्न
कराने के लिए उत्तर भारत में यात्राएं करती हूं.
23-9-2008 से 4-10-2008 के दौरान मैं इंदौर में
थी और यहां मैं अपने एक शिष्य अण्णाजी के घर
रूकी थी. 4 अक्टूबर की शाम को मैं अपने आश्रम
जबलपुर वापस आ गयी.

7-10-2008 को जब मैं अपने जबलपुर के आश्रम में
थी तो शाम को महाराष्ट्र से एटीएस के एक पुलिस
अधिकारी का फोन मेरे पास आया जिन्होंने अपना नाम
सावंत बताया. वे मेरी एलएमएल फ्रीडम बाईक के बारे
में जानना चाहते थे. मैंने उनसे कहा कि वह बाईक
तो मैंने बहुत पहले बेच दी है.

अब मेरा उस बाईक से कोई
नाता नहीं है. फिर भी उन्होंने मुझे कहा कि अगर मैं सूरत
आ जाऊं तो वे मुझसे कुछ पूछताछ करना चाहते हैं.

मेरे
लिए तुरंत आश्रम छोड़कर सूरत जाना संभव
नहीं था इसलिए मैंने उन्हें कहा कि हो सके तो आप
ही जबलपुर आश्रम आ जाईये, आपको जो कुछ पूछताछ
करनी है कर लीजिए.

लेकिन उन्होंने जबलपुर आने से
मना कर दिया और कहा कि जितनी जल्दी हो आप सूरत
आ जाईये. फिर मैंने ही सूरत जाने का निश्चय किया और
ट्रेन से उज्जैन के रास्ते 10-10-2008 को सुबह सूरत
पहुंच गयी.

रेलवे स्टेशन पर भीमाभाई पसरीचा मुझे लेने
आये थे. उनके साथ मैं उनके निवासस्थान एटाप नगर
चली गयी.

यहीं पर सुबह के कोई 10 बजे मेरी सावंत से मुलाकात
हुई जो एलएमएल बाईक की खोज करते हुए पहले से
ही सूरत में थे. सावंत से मैंने पूछा कि मेरी बाईक के साथ
क्या हुआ और उस बाईक के बारे में आप पडताल
क्यों कर रहे हैं?

श्रीमान सावंत ने मुझे बताया कि पिछले
सप्ताह सितंबर में मालेगांव में जो विस्फोट हुआ है उसमें
वही बाईक इस्तेमाल की गयी है. यह मेरे लिए
भी बिल्कुल नयी जानकारी थी कि मेरी बाईक
का इस्तेमाल मालेगांव धमाकों में किया गया है. यह
सुनकर मैं सन्न रह गयी. मैंने सावंत को कहा कि आप
जिस एलएमएल फ्रीडम बाईक की बात कर रहे हैं
उसका रंग और नंबर वही है जिसे मैंने कुछ साल पहले बेच
दिया था.

सूरत में सावंत से बातचीत में ही मैंने उन्हें
बता दिया था कि वह एलएमएल फ्रीडम बाईक मैंने
अक्टूबर 2004 में ही मध्यप्रदेश के श्रीमान
जोशी को 24 हजार में बेच दी थी. उसी महीने में मैंने
आरटीओ के तहत जरूरी कागजात (टीटी फार्म) पर
हस्ताक्षर करके बाईक की लेन-देन पूरी कर दी थी. मैंने
साफ तौर पर सावंत को कह दिया था कि अक्टूबर 2004
के बाद से मेरा उस बाईक पर कोई अधिकार नहीं रह
गया था. उसका कौन इस्तेमाल कर रहा है इससे
भी मेरा कोई मतलब नहीं था. लेकिन सावंत ने
कहा कि वे मेरी बात पर विश्वास नहीं कर सकते. इसलिए
मुझे उनके साथ मुंबई जाना पड़ेगा ताकि वे और एटीएस
के उनके अन्य साथी इस बारे में और पूछताछ कर सकें.

पूछताछ के बाद मैं आश्रम आने के लिए आजाद हूं.
यहां यह ध्यान देने की बात है कि सीधे तौर पर मुझे
10-10-2008 को गिरफ्तार नहीं किया गया. मुंबई में
पूछताछ के लिए ले जाने की बाबत मुझे कोई सम्मन
भी नहीं दिया गया.

जबकि मैं चाहती तो मैं सावंत
को अपने आश्रम ही आकर पूछताछ करने के लिए मजबूर
कर सकती थी क्योंकि एक नागरिक के नाते यह
मेरा अधिकार है. लेकिन मैंने सावंत पर विश्वास
किया और उनके साथ बातचीत के दौरान मैंने कुछ
नहीं छिपाया. मैं सावंत के साथ मुंबई जाने के लिए तैयार
हो गयी. सावंत ने कहा कि मैं अपने पिता से भी कहूं
कि वे मेरे साथ मुंबई चलें. मैंने सावंत से
कहा कि उनकी बढ़ती उम्र को देखते हुए उनको साथ
लेकर चलना ठीक नहीं होगा.

इसकी बजाय मैंने
भीमाभाई को साथ लेकर चलने के लिए कहा जिनके घर
में एटीएस मुझसे पूछताछ कर रही थी.
शाम को 5.15 मिनट पर मैं, सावंत और भीमाभाई सूरत
से मुंबई के लिए चल पड़े. 10 अक्टूबर को ही देर रात हम
लोग मुंबई पहुंच गये.

मुझे सीधे कालाचौकी स्थित
एटीएस के आफिस ले जाया गया था. इसके बाद अगले
दो दिनों तक एटीएस की टीम मुझ?से पूछताछ
करती रही. उनके सारे सवाल 29-9-2008 को मालेगांव
में हुए विस्फोट के इर्द-गिर्द ही घूम रहे थे.
मैं उनके हर
सवाल का सही और सीधा जवाब दे रही थी.
अक्टूबर को एटीएस ने अपनी पूछताछ का रास्ता बदल
दिया. अब उसने उग्र होकर पूछताछ करना शुरू किया.
पहले उन्होंने मेरे शिष्य भीमाभाई पसरीचा (जिन्हें मैं
सूरत से अपने साथ लाई थी) से कहा कि वह मुझे बेल्ट
और डंडे से मेरी हथेलियों, माथे और तलुओं पर प्रहार करे.
जब पसरीचा ने ऐसा करने से मना किया तो एटीएस ने
पहले उसको मारा-पीटा. आखिरकार वह एटीएस के
कहने पर मेरे ऊपर प्रहार करने लगा. कुछ भी हो, वह
मेरा शिष्य है और कोई शिष्य अपने गुरू को चोट
नहीं पहुंचा सकता. इसलिए प्रहार करते वक्त भी वह इस
बात का ध्यान रख रहा था कि मुझे कोई चोट न लग
जाए. इसके बाद खानविलकर ने उसको किनारे धकेल
दिया और बेल्ट से खुद मेरे हाथों, हथेलियों, पैरों, तलुओं
पर प्रहार करने लगा. मेरे शरीर के हिस्सों में
अभी भी सूजन मौजूद है.
13 तारीख तक मेरे साथ सुबह, दोपहर और रात में
भी मारपीट की गयी. दो बार ऐसा हुआ कि भोर में चार
बजे मुझे जगाकर मालेगांव विस्फोट के बारे में मुझसे
पूछताछ की गयी. भोर में पूछताछ के दौरान एक
मूछवाले आदमी ने मेरे साथ मारपीट की जिसे मैं
अभी भी पहचान सकती हूं. इस दौरान एटीएस के
लोगों ने मेरे साथ बातचीत में बहुत
भद्दी भाषा का इस्तेमाल करना शुरू कर दिया. मेरे गुरू
का अपमान किया गया और मेरी पवित्रता पर सवाल
किये गये. मुझे इतना परेशान किया गया कि मुझे
लगा कि मेरे सामने आत्महत्या करने के अलावा अब
कोई रास्ता नहीं बचा है.
14 अक्टूबर को सुबह मुझे कुछ जांच के लिए एटीएस
कार्यालय से काफी दूर ले जाया गया जहां से दोपहर
में मेरी वापसी हुई. उस दिन मेरी पसरीचा से कोई
मुलाकात नहीं हुई. मुझे यह भी पता नहीं था कि वे
(पसरीचा) कहां है. 15 अक्टूबर को दोपहर बाद मुझे
और पसरीचा को एटीएस के वाहनों में नागपाड़ा स्थित
राजदूत होटल ले जाया गया जहां कमरा नंबर 315 और
314 में हमे क्रमशः बंद कर दिया गया. यहां होटल में
हमने कोई पैसा जमा नहीं कराया और न ही यहां ठहरने
के लिए कोई खानापूर्ति की. सारा काम एटीएस के
लोगों ने ही किया.
मुझे होटल में रखने के बाद एटीएस के लोगों ने मुझे एक
मोबाईल फोन दिया. एटीएस ने मुझे इसी फोन से अपने
कुछ रिश्तेदारों और शिष्यों (जिसमें मेरी एक
महिला शिष्य भी शामिल थी) को फोन करने के लिए
कहा और कहा कि मैं फोन करके लोगों को बताऊं कि मैं
एक होटल में रूकी हूं और सकुशल हूं. मैंने उनसे पहली बार
यह पूछा कि आप मुझसे यह सब क्यों कहलाना चाह रहे
हैं. समय आनेपर मैं उस महिला शिष्य का नाम
भी सार्वजनिक कर दूंगी.
एटीएस की इस प्रताड़ना के बाद मेरे पेट और किडनी में
दर्द शुरू हो गया. मुझे भूख लगनी बंद हो गयी.
मेरी हालत बिगड़ रही थी. होटल राजदूत में लाने के कुछ
ही घण्टे बाद मुझे एक अस्पताल में
भर्ती करा दिया गया जिसका नाम सुश्रुसा हास्पिटल
था. मुझे आईसीयू में रखा गया. इसके आधे घण्टे के अंदर
ही भीमाभाई पसरीचा भी अस्पताल में लाये गये और
मेरे लिए जो कुछ जरूरी कागजी कार्यवाही थी वह
एटीएस ने भीमाभाई से पूरी करवाई.
जैसा कि भीमाभाई ने मुझे बताया कि श्रीमान
खानविलकर ने हास्पिटल में पैसे जमा करवाये. इसके बाद
पसरीचा को एटीएस वहां से लेकर चली गयी जिसके बाद
से मेरा उनसे किसी प्रकार का कोई संपर्क
नहीं हो पाया है.
इस अस्पताल में कोई 3-4 दिन मेरा इलाज किया गया.
यहां मेरी स्थिति में कोई सुधार नहीं हो रहा था तो मुझे
यहां से एक अन्य अस्पताल में ले
जाया गया जिसका नाम मुझे याद नहीं है. यह एक
ऊंची ईमारत वाला अस्पताल था जहां दो-तीन दिन
मेरा ईलाज किया गया. इस दौरान मेरे साथ कोई
महिला पुलिसकर्मी नहीं रखी गयी. न ही होटल राजदूत
में और न ही इन दोनो अस्पतालों में. होटल राजदूत और
दोनों अस्पताल में मुझे स्ट्रेचर पर लाया गया, इस
दौरान मेरे चेहरे को एक काले कपड़े से ढंककर रखा गया.
दूसरे अस्पताल से छुट्टी मिलने के बाद मुझे फिर एटीएस
के आफिस कालाचौकी लाया गया.
इसके बाद 23-10-2008 को मुझे गिरफ्तार किया गया.
गिरफ्तारी के अगले दिन 24-10-2008 को मुझे मुख्य
न्यायिक मजिस्ट्रेट, नासिक की कोर्ट में प्रस्तुत
किया गया जहां मुझे 3-11-2008 तक पुलिस कस्टडी में
रखने का आदेश हुआ. 24 तारीख तक मुझे वकील
तो छोड़िये अपने परिवारवालों से भी मिलने की इजाजत
नहीं दी गयी. मुझे बिना कानूनी रूप से गिरफ्तार किये
ही 23-10-2008 के पहले ही पालीग्रैफिक टेस्ट
किया गया. इसके बाद 1-11-2008
को दूसरा पालिग्राफिक टेस्ट किया गया. इसी के साथ
मेरा नार्को टेस्ट भी किया गया.
मैं कहना चाहती हूं कि मेरा लाई डिटेक्टर टेस्ट और
नार्को एनेल्सिस टेस्ट बिना मेरी अनुमति के किये गये.
सभी परीक्षणों के बाद भी मालेगांव विस्फोट में मेरे
शामिल होने का कोई सबूत नहीं मिल रहा था.
आखिरकार 2 नवंबर को मुझे मेरी बहन प्रतिभा भगवान
झा से मिलने की इजाजत दी गयी. मेरी बहन अपने साथ
वकालतनामा लेकर आयी थी जो उसने और उसके पति ने
वकील गणेश सोवानी से तैयार करवाया था. हम लोग
कोई निजी बातचीत नहीं कर पाये क्योंकि एटीएस
को लोग मेरी बातचीत सुन रहे थे. आखिरकार 3 नवंबर
को ही सम्माननीय अदालत के कोर्ट रूम में मैं चार-पांच
मिनट के लिए अपने वकील गणेश सोवानी से मिल पायी.
10 अक्टूबर के बाद से लगातार मेरे साथ जो कुछ
किया गया उसे अपने वकील को मैं चार-पांच मिनट में
ही कैसे बता पाती? इसलिए हाथ से लिखकर माननीय
अदालत को मेरा जो बयान दिया था उसमें विस्तार से
पूरी बात नहीं आ सकी. इसके बाद 11 नवंबर
को भायखला जेल में एक महिला कांस्टेबल
की मौजूदगी में मुझे अपने वकील गणेश सोवानी से एक
बार फिर 4-5 मिनट के लिए मिलने का मौका दिया गया.
इसके अगले दिन 13 नवंबर को मुझे फिर से 8-10 मिनट के
लिए वकील से मिलने की इजाजत दी गयी. इसके बाद
शुक्रवार 14 नवंबर को शाम 4.30 मिनट पर मुझे मेरे
वकील से बात करने के लिए 20 मिनट का वक्त
दिया गया जिसमें मैंने अपने साथ हुई सारी घटनाएं
सिलसिलेवार उन्हें बताई, जिसे यहां प्रस्तुत किया गया है.
