जारी कर कहा है कि वट्सऐप पर अगर
कोई कंटेंट डाला जाता है और वह आपत्तिजनक है
तो ऐसा कंटेंट डालने वाले शख्स के खिलाफ
कानूनी कार्रवाई होगी। अगर
कंटेंट किसी ग्रुप में डाला जाता है तो वट्सऐप
पर इस तरह का ग्रुप बनाने वाले एडमिन के खिलाफ
भी कार्रवाई होगी।
कानूनी जानकार बताते हैं कि कोई
भी कंटेंट जो कानून की नजर में
गलत है और व कंटेंट अगर नेट व सोशल साइट्स पर
डाला जाता है तो ऐसा कंटेंट डालने वाले शख्स के खिलाफ
कानूनी कार्रवाई किए जाने का प्रावधान है।
सोशल साइट व नेट पर डाले गए कोई भी कंटेंट
जो कानूनी तौर पर गलत है तो उसके लिए
आईटी एक्ट के तहत प्रावधान
किया गया है। दिल्ली हाई कोर्ट के पूर्व
स्टैंडिंग काउंसिल पवन शर्मा बताते हैं कि ऐसा कोई कंटेंट
जो दूसरे की भावनाओं को आहत करता है
या फिर दो समुदाय में नफरत फैलाता है या फिर
मानहानि करता है या फिर किसी तरह से
कानून का उल्लंघन करता है तो ऐसे कंटेंट डालने वाले के
खिलाफ कार्रवाई का प्रावधान है। अगर ऐसा कंटेंट
किसी वट्सऐप ग्रुप में डाला जाता है और
वह सर्कुलेट किया जाता है तो निश्चित तौर पर ग्रुप
एडमिन भी जिम्मेदार होगा। अगर ग्रुप एडमिन
ने ऐसे कंटेंट डालने वाले के खिलाफ कार्रवाई करते हुए उसे
ग्रुप में बैन कर दिया हो और उस कंटेंट
को हटा दिया हो तो यह उसका बचाव
हो सकता है। क्योंकि ऐसे ग्रुप का गलत इस्तेमाल
करना और ऐसे कंटेंट डालना और सर्कुलेट करना इसे
बढ़ावा देने के बराबर है। कोई कंटेट डालता है और
दूसरा अगर उसको लाइक करता है और वह कंटेंट
आपत्तिजनक है तो दोनों के खिलाफ कार्रवाई
हो सकती है।
साइबर मामलों के एक्सपर्ट पवन दुग्गल बताते हैं कि कोई
भी कंटेंट जो आपत्तिजनक है और
कानूनी तौर पर गलत है अगर उसे नेट पर
डाला जाता है तो निश्चित तौर पर ऐसा कंटेंट डालने
वाला शख्स और ग्रुप एडमिन जिम्मेदार होगा।
आपत्तिजनक कंटेंट डालने वाले शख्स और ग्रुप एडमिन
दोनों के खिलाफ कार्रवाई की जाएगी।
अगर ग्रुप एडमिनिस्ट्रेटर को इस तरह के आपत्तिजनक
कंटेंट के बारे में

किसी अन्य शख्स को आघात हुआ
हो या उसका डिफेमेशन हुआ है या फिर दो समुदाय में
नफरत फैली हो या फिर धार्मिक भावनाओं
को ठेस पहुंचा हो तो ऐसे किसी मामले में
आईटी एक्ट के तहत केस दर्ज
हो सकता है।
साइबर मामलों के एक्सपर्ट विराग गुप्ता बताते हैं कि नेट
यूजर्स को आईटी एक्ट के प्रावधानों के बारे में
जानना जरूरी है। एक्ट में कंटेंट डालने वाले
परिभाषित हैं साथ ही जो उसके लिए
प्लैटफॉर्म देता है वह भी परिभाषित हैं।
नेट की सामग्री के लिए प्लेटफॉर्म
देने वाले इंटरमेडियरी कहे जाते हैं और
उन्हें आईटी एक्ट की धारा-79
के तहत छूट मिली हुई है
यानी उनके खिलाफ एक्शन
नहीं हो सकता।
जहां तक किसी ग्रुप के एडमिन का सवाल
है तो उसे हम एजेंट के तौर पर देख सकते हैं। ऐसे
एडमिन की जिम्मेदारी है
कि उनके ग्रुप में ऐसे लोग शामिल हों जो कोई
गैरकानूनी गतिविधि न करते हों। बावजूद इसके
अगर किसी ने ग्रुप में ऐसा कंटेंट डाला जो कानून
के खिलाफ है तो एडमिन
की जिम्मेदारी बनती है
कि तत्काल उसे रोके और अगर वह
ऐसा नहीं करता तो अपनी जिम्मेदारी से
बच नहीं सकता। आईटी एक्ट
की धारा-66 ए
का दायरा काफी व्यापक है। कोई
भी ऐसा कंटेंट जो कानून के नजर में गलत है,
वह अगर सोशल साइट या फिर नेट के जरिये डाला जाता है
तो वह अपराध की श्रेणी में
आता है और इसके लिए आईटी एक्ट
की धारा-66 ए के तहत केस दर्ज
हो सकता है।
वैसे सरकार ने आईटी ऐक्ट
की धारा-66 ए के तहत होने
वाली गिरफ्तारी के मामले में गाइड
